(2) If you are subject to the "two year foreign residence requirement", you can not get H1B according to the 212(e).

About my RFE:

The info you provided in this application .... subject to the two year residence requirement of Section 212(e)...
Therefore you must submit evidance evidence that you have resided in your home country at least 2 years...

OR

you must submit an approval notice (Form I-797) issued by this Service to establish that you have applied for and been granted a waiver of the two year foreign residance requirement.

That is it.(omitted is not important)
