Can I apply H4 for my husband?

I am currently in the process of H1-B transfer because of changing job. I want apply H4 for my hu*****and with my H1-B petition. But the attorney of my new company said that I would not apply H4 for my hu*****and because he is not in U.S.

Is this true?
