I have an approved AP, but my understanding is that if I use it to come back the US, I may lose my H1 status and have to use EAD.

If that's the case, my daughter cannot apply for H4. Am I right? so I need to apply for H1 visa for coming back, is this my best choice?
- Since you have not used AP yet when your kid applies for H-4, I believe there is no problem. However, if you could use H-1 visa to enter US with her H-4, you may save possible trouble at Customs if any.
