pjiang - please shed some light!

I am trying to switch job using EAD (employment-based) under AC21 since my current company is going down soon. My new job is very similar to my current one, but is a contract-to-permanent position (3-month contract first, then converted to permanent). Will it be an issue? I heard of that a new job under AC21 must be a permanent position. Is this true?

Also, my current annual salary is 91K (vs 73K prevailing wage based on my current job as on my I-140), and my new wage will be 75K (vs 78K prevailing wage based on my new job as it is in a different city but still in the same State). Let's assume my wage will still be 75K at the time USCIS sends RFE some day. I heard of that as long as my new wage is more than 95% of the required prevailing wage, the new wage won't be a problem. Is it true? Will that my salary drops from 91K to 75K be another issue?
