140被拒，请教各位大侠

140因为多个错误被拒，律师说可以用同一个perm的劳工卡再file一个140。收到的移民局的拒信说的是：

In accordance with a USCIS announcement dated on May 24, 2007, the petitioner may elect to file a new petition on the beneficiary's behalf requesting a different visa classification but supported by the instant labor certification. (A motion making this request would be denied.) If the petitioner elects to pursue this option, it should include a copy of this denial notice, and clearly report that the original labor certification is with LIN# housed in file #XXX.

问题1：括号里说motion还是会被拒掉是什么意思，如果这样的话再递一个不同visa classification的petition会直接被拒掉吗，还是motion与petition是完全不同的两码事。

问题2：instant labor certification是什么意思，要重新办perm吗，还是可以像律师说的用去年的perm再递一个不同类别的140申请。original labor certification应该指的就是去年的这个perm，是否就是前面提到的这个instant labor certification。
