Can I apply H-4 to return to US?

I currently hold a h-1b visa, which will expire on Dec 31, 2007. I submitted 485 application with my spouse who is also holding a h-1b visa till Sep 30, 2008. I do not have AP. If I leave US at the end of Dec, can I apply for H4 to re-enter US? Will it affect 485? Thanks
