Am I legally stay in us?"?"?"?

My OPT expires on Aug 15. The layer told me I need to have a legal visa between Aug15 to Oct 1st if I want to apply H1B successfully, otherwise INS will be asking for this. Is this true? Do I really need visa to cover this period time(Aug15-Oct1)I heard before is ok to stay as long as INS received application. But the H1B start from Oct 1st is belong to 2005, I need visa to cover this period time after my OPT expired. Please give me more ideas!!! Thanks a lot!!!
