help, 485 returned !!

Hi, all

I received my returned I-485 package from NSC. They claim that I did not include the I-140 receipt notice. Because I didn't receive I-140 receipt notice so I included the cashed check. Actually my I-140 was approved in August in TSC.

My attorney is going to resubmit it with explanation. My question is: They will accept it or not because my PD is April, 2007. I need to include new fee or old fee? I am really frustrated. Thank you for any input.
