看房给Offer 以及Agent Fee的问题

Located on Long Island, NY.ask for $445,000.
We do not have agent. So we directly gave out the offer ($380,000) to the seller agent. She said our offer is too low, because the owner already had an $ 400.000 offer, and the owner took it, but, for some reason the contract failed.

So, what you think about this offer?

If we do not have agent, does that mean the seller's agent could get 5-6% commision fee or still half of the total commission fee?
