H-1B extension pending, can I use AP?

My current H-1B will expire in December this year and My H-1B extension was filed in early August, still pending. I'll take a trip back to China and plan to use AP to come back. According to my lawyer, I will lose my H-1B status once I use AP. I know there has been a lot of debate and I'm inclined to believe you will enter the H-1B/AOS dual status in this situation. but I'm not sure if I use AP, whether there will be any negative impact on my H-1B extension itself. will this automatically render my H-1B application invalid? any feedback is highly appreciated.
