请大家帮忙指点一下身份问题

本人现在是H1B.今天刚递了h1-H4的申请。被告知要5个月才能批下来。我的问题是：
1． 我现在可以辞职吗？还是要等到拿到收据？多久才能拿到收据？
2． 如果现在可以辞职，那我的身份是不是H4 pending? 如果pending 5个月对将来申请绿卡会不会有影响(如out of status for 5 minths)? 请问有何法律规定吗?
