A strange H1B transfer case:
I worked for A and got paid till May 31, 2007, I797 for A is to June 31, 2007;
I started working for B from June 1, 2007 and got paid from June 1, 2007. B filed a H1B transfer to VSC on May 21, 2007, but did not provide my latest W2 and my last three month pay from A;
I got my GC on July 2, 2007, NSC approved my I485;
I have EAD from July 2006 and renewed it to June 2007 (no gap in the period, NSC, I did not show it to my current employer A).
Yesterday, we received a mail from VSC and let us submit my latest W2 /1099 and my last three month pay statements from A, and told that VSC would reject my H1B transfer application if we could not provide these documents and let me go back to China to issue H1b visa :((
Q: 1) How will it be going on after VSC receive my pay statement documentation?
2) Will this H1b transfer be rejected? If it will, what is my status between June 1 to June 2, 2007?
3) Our secretary thought if my case was rejected, my status will have a gap in this period (06/01-07/02), and I was 'illegal' employee at that period???
4) Seems VSC didn't know my GC was approved in NSC, if VSC will provide a reason to 'reject' this case because of 'GC' approval. And state my status has no gap?
