You do need to leave, so does your TN wife and kid(s). If you leave after 180 days of 7/28, it has impact on your GC later.
If your wife applies H-1 during her being out of status within US, she may be approved while still needs to leave US so as to receive an I-94.

Suggestion: you may need to consult a different attorney. From what information you released, your current attorney has done something inappropriately 1) your attorney applied I-140 (NIW, EB-1a?) based on TN of your wife; 2) your attorney did not see how your TD expiration affects your families' status
