在阅读文章后, 我的具体情况不能找到EXACT的答案. 因此再请教:
我和LG一起申请485(同时申请了EAD和AP), 材料8月16日送到NSC,EB2. 140已批准. 他有急事出差,已经于昨天飞回中国.他的H1签证(2次ENTRY,只用掉一次)有效到10月29日. 我们的计划是他在中国等到485收据原件再回美. 我的具体问题是:
1. 如果10月29日前他能成行(485收据收到),进关的时候他应该主动出示485收据吗?
- Present receipt when requested

2. 如果10月29日前不能成行, 他能再在中国签H1签证吗? 这样等收据最终收到, 他还是有有效的H1签证入境.
- Sure

3. 如果他用H1签证和485收据顺利入境, 我们的AP 申请还是会作废吗? 可以再申请一次吗?
- Theoretically voided. You may apply another one.

4. 是不是AP和485收据会同时收到? 他是不是应该等到收到AP才入境呢?
- Maybe. He may try using AP too.

Please understand the 2 restrictions on AP and I-485 original receipt, are USCIS' published policies. Practically some people have their own practices which contradict with such policies. So not complying with above policies does not guarantee a refusal on admission, and your discretion is required.
