我是不是黑身份了？

我是2001年8月7日持H1B1入境的，今年8月7日，六年到期。
但我签证上的截至有效日期09/29/2007。
劳工纸已下来，但还未申请I-140.
5月30日，让律师申请H1第七年延期，但不知他为什末非常拖拉。
我在USCIS网站上看到，VERMONT中心是8月8日才收到I-129，还在pending.
本指望在H1第七年, 接着进行绿卡的申请，被他这莫一搞，气晕了。
我是不是黑身份了？如何面对该律师？
