I am going to lose job and H1 next month. If I get a new job offer starting from 1/1/2008 and the institute agree to sponsor H1 for me (non- profit institute), What do I do with the gap in-between?
- There is no gap since you have 485 pending.

My hu*****and is holding H1 and both our 485 are pending. My hu*****and is the primary applier. Do I have to apply H4 to fill the gap.
- You don't have to, but it helps. If you don't change to H-4, you may need to apply H-1 visa overseas then.
