苦等了一年多的140在RFE后被拒。我想appeal。但是在I-290B的instruction 中Who may not file this form?中说道:
"If you are the beneficiary of a visa petition or the beneficiary's attorney or representative, you may not file an appeal or motion."

我是NIW，self-petition (have attorney).我既是petitioner又是beneficiary.这种情况我能自己file appeal 吗？

另外，我如果选择B(I am filing an appeal. My brief or evidence is attached will be submitted to the AAO within 30 days.) in part 2, 我是不是在file I-290B 后有30天时间收集evidence?
