Yes, the H visa has dual intent, which means you could have immigration intention. In my opinion, the CIS will never know you used EAD or not, because the I-9 form is not going to be submitted to CIS(read the instruction of I-9 form).If your H-4 I-94 is still valid, the CIS never knows.Your case used to be rare, but it becomes popular, because it comes from the concurrently filing, and it is the grey area.
