True or False, No visa available for my I-485 filed three years

Hi,

I just asked a senator's office to check the status of my I-485 (concurrenly file with I-140, NIW-based). I was told that all background checks and fingerprints have been completed. However, my case is now waiting for a visa to become available.I know the August visa is not available and no new I-485 can be filed later. However,my I-485 was filed on Aug, 2004. There are several cases approved recently in our forum. How can I argue with USCIS for my case?
