"DHL can attest the sent data to USCIS on July 26th"? Can you release DHL tracking#?

Right now I'm confused that who lost the package, it is DHL rather than USCIS, right? Then how could USCIS accept a third parties' testify to interface itself?

Due to the cover letter issue of your attorney, I am totally negative on him. I would not trust him that the now-filed I-140 would be accepted by USCIS to put you "under the July Bulletin". Hence I would not waste my money to file I-485 which will be denied for certain because of visa number availability, although I'm not sure if the I-485 will just be rejected in such case with no monetary loss.

Unless I were in a position in need of EAD/AP badly, and don't care to take the chance, I would hold off any further action.
