Urgent advice about TD visa !

My son is applying for TD visa, but my TN visa has 3 month left.
What should he say if immigration officer say: "you do not
need any visa for visiting your father in US because he has a Canadian passport".

But we do need my son to have a TD visa. Please give me your advice.
