As long as you can obtain labor within 3 years, you then can file i-140,i-485, EAD, and AP. You can stay and work in US after that, based on your Adjustment of Status and work permit. And you can travel and reenter the United States with your Advance Parole. I know it take a long time to get GC, but as long as you obtain your Labor and filed your i-485, you are basically safe. In virginia, Labor take about 2 years. Many of my co-workers filed GC on the 5th of 6th year of their H1-B and we don't see any issues. Take it easy! :--)
