need original LC for I-140?

Hi, my lawyer has filed labor certificate based EB2 for me. We have not got approved yet. Now I find out they messed it up because the job requirement they stated on the advertising and labor certificate does not qualify EB2. So I am worried my applicaton will be denied. I am thinking about filing a new application for EB3 using the same labor certificate. Do we have to use the original labor certificate for the new application? I have a copy, but the original one is in USCIS for the pending case.
