EB2 140 filed on Aug.2006 was denied in the middle of this month.
Is it doable to file Motion to reopen and file a new 140 in the EB2 category again at the same time? Or just file a motion to reopen?

My lawyer suggested to file a new EB3 140 using the same labor which was approved July 2006. Since the new regulation says the labor should be used within 180 days after it is approved, I don’t know if I can use the same labor instead of applying for a new one?
- yes, because you got 180 days after the new regulation became effective
