Out of Status?

Hi,

I am currently working on my OPT, and it will expire on October 2004. My company didn't get the H-1b visa for me due to the cap. Then they applied for Green Card for me since I married to a US citizen. However, the receipt for the green card application is not here yet (filed on March 22, 2004).

I would like to ask whether anyone knows what is the normal waiting time for the receipt green card since Feb 17, 2004 (after this date, all the new green card application through family members are forwarded to the National Benefit Center in Missouri by local office). It has been more than a month for me now.

Also, am I out of status if I still didn't get the receipt after Oct 15, 2004 (when my OPT expires)? Or the receipt doesn't mean anything. I have to get a new EAD card to be in status? (I am not even counting on working. I just want to have legal status to be in this country, for it will be a disaster if I have to leave my hu*****and).
