out of status or not?

我劳工的I140和I485在JUL09同时被deny,被deny时是H4身份,而且已经用了EAD,但他随我又在这个June30递交了一份485,receipt date应该是JUL2,这样一来就衔接上了,请问这样一来他是不是就没有out of status了?谢谢!
