F1-grace period-H1b

Hi, Every one, I have had big problem that I just got my H1 B approved, but I didn't get my F1-H1b approved because of gap.In a reslut , need go to Canda or China to change my status. Actually I can apply for F2 to go through that period. I don't know if I can apply I539 to change my status from F2 to H1B in america? I still do not want to go to canada to get My H1b visa, it has any risk? My lawyer said I will get H1B visa through canada with 99.99% successful rate? Any one has same situation as me? Any opinion?
