gap period question

I applied for my OPT this March and supposed to get it approved in June. My CPT will be used up in May, so there is a one-month gap period. Now the company said I can't work for them during the gap, even I will work for free. Can I tell them I can stay in the company as an observer, or visitor? Is it legal? In fact I just want to learn some skills. Thanx!
