1) your 1st 485 was received and fee cashed, but you choose to file a new one, you will have to withdraw the 1st 485 and answer "yes" on your 2nd 485;

2) you 1st 485's fee is yet cashed, so you may cancel the check so the 1st petition will be returned to you. In this case, I would answer "no" on my 2nd 485.
