Mostly in the case of EB1b. But that doesn't mean you can not get recommendation letters from University professors. Writing recommendation letters is the personal support for whoever she likes.
Many NIW petitioners are postdocs. If you can not pursuade your boss, try get letters from other professors or get referees from your boss.
