这取决于你办理adoption的国家的法律，在中国除非十分特别的情况

在你完成adoption前，根本没办法拿到legal custody ，那不是你说就可以，要法官判给你才行的。
在某些国家的民法中允许父母之外的人有legal custody，那当然是可以的
