substitution is allowed after 07/16/07. This is a very good opportunity for you. You can not file I-485 now since all EB categories are "U" now. Even though your effort is unsuccessful, it should not affect your I-140/I-485 application in the future. You need to talk with your attorney regarding whether your background matches the EB2 requirements. Good luck!
