Consult lawyer: H-1 sponsor

I am architecture student who will graduate soon. My advisor is going to hire me. He used has a good firm with 20 employee. However, he broke with his partner, recently, and set up his own design firm. That means his firm is really small and young. Now he only has 2 employees. Both of us are his students.
Does his firm sponsor my H-1 visa will be very difficult to be approved?
