Hi xiaobaitu or other expert,
Here are my situation and my questions:
(1) I am currently with F2 visa. My hu*****and will go back China at the late of July or early August although his F-1 visa is still good until Sept. Do I have still legal status before Sept even though He has left US in July or August?
(2) I am applying for changing my status from F-2 to F-1. I have already got an I-20 and will file I-539 very soon. But, it will take USCIS almost 3.5 month to process the I-539 application. Obviously I will be out of status at the time my I-539 application get approved. My friend told me as soon as I get a receipt from USCIS, I am in a legal status. Is it right?
(3) If an application material in my I-539 application package is missing, what will it happen? Does USCIS will return my application? Or reject my application? Or request the material?
