If you file I140 and I485 at the same time, you still can remain your H1 status, however, if your dependant use EAD to work, once your I140 get rejected, she/he is out of status immidiately. But she/he is allowed to leave U.S and issue a new H4. Your H1 is still valid eventhough your I140 got rejected.
