急问生物类博士后换工作问题

生物类大学博士后， 我的h1-B 明年到期，但是老板让我现在走人。我想问：
1. 如果我现在找别的学校博士后，在我离开这里之前可以递上新的H1B申请，但在批准之前和现在的工作可能中间有gap，请问我可以合法的在美国等吗？
2. 140 pending 期间可以换工作吗？ 如果都是科研领域的话。
