To upgrade your I-140 petition to premium processing, Please understand the following paragragh from I-907:
"Only the petitioner or applicant who filed the correspondingpetition or application (e.g. Form I-129), or the attorney oraccredited representative of the petitioner or applicant, mayrequest Premium Processing Service. If the attorney oraccredited representative makes the request, a properlycompleted Notice of Appearance (Form G-28) mustaccompany the request, even if the attorney or accreditedrepresentative has already filed a Form G-28 in the case."
My understanding is that you or the company lawyer might do so without any problem. However my suggestion is that you try to talk to the original lawyer and tell them you can pay the attorney fee.
