man, have you read entire article? Don't you see the "initial evidence missing" part that start on 06/16/2007, any case after that date with initial evidence missing will be denied? RFE will be issued for cases ted before 06/16/2007.

I have been kept eyes on it started on Feb when this rule was ted to OMB.
