请教小白兔，关于OPT 和H4的gap

Here is the case:

OPT expired on May 12, 2005. H4 filed and received receipt notice on Apr. 4, 2005. H4 got approved with the valid date starting from Aug. 2, 2005. Then LD got H1 approved with the valid date starting from Aug. 12, 2005. We are going to file 485 now. Here is our question:

During the H4 pending period, from May 12 to Aug.2, 2005, LD stayed in US. Is her stay legal or illegal? If illegal, what should we do now?
