xiaobaitu及各位专家:h4-pending question

my hu*****and went to guangzhou for h4(not the first time)
visa officer ask him for his h4-797, not my h1-b 797.
my hu*****and told visa officer he do not have h4-797 and should not have it
but the officer will not give him h4 visa if he do not provide the h4-797.
what can we do? please please give some advice.
