J-1 waivered ?

My case is recommondation letter sent to the INS Dec.09
Got the copy of the letter from DOS Jan 22nd, still didn't get a notice or a approval from INS. My university is working on mine H-1B now.
My questions are:
1. Can I go ahead send the application to the INS only using the letter copy from DOS to get my H-1B?
2. Did anyone get the notice from INS yet recently?
I'm in texes center, by the way!
Please share some imformations with me !!!
