You need to contact your local tax office and make up you tax return last three years. Not only you have chance to endanger your GC application, but also you could be audited by IRS, even many years later. That happened before. You are not entitled for this treaty.

H-1 treaty refers to those who get their H-1b visa from China to enter the US, not those who transfer their H-1b status (such as from F-1) inside the US. That is a big mistake.

My advice, as a foreigner, never screw up your tax return anytime, especially before you get your GC.
