A letter from company attorney about two I-485

You have two I-485 applications pending (one based on your approved National Interest Waiver I-140 and one based on your approved Extraordinary Ability I-140). This is a problem, as you are not allowed to have more than one I-485 application pending at the same time. Therefore, you will need to withdraw one of the pending applications.

Since the priority date for your National Interest Waiver is still retrogressed, I strongly recommend that you withdraw the I-485 application which is connected to that petition (i.e. the I-485 application which was filed in September 2005). This would allow the I-485 application which you filed in January 2007 based on your Extraordinary Ability petition to be adjudicated, since the priority date for that petition is current at this time.

Please provide my office with a copy of your I-485 receipt notices, as well as the letter which you send to CIS to withdraw the earlier I-485 application, for your file.
