Your lawyer should have thought this through in the beginning. Understanding that whether there can be multiple opening, whether the boss was willing to hire another person besides you, or is it absolutely only one position which you now hold. At this stage, if ad already only asking one and boss is not willing to compromise, very hard (for an honest application).
