法居士/假博士/expert: when to get AP

I am currently on H-1b and appling for my L/C. My L/C application is not submitted yet, still doing the advertising for RIR.

I learned from other posts that I can get AP before I140 is approved. I would really like to travel back to China, so I was just wondering if I can get my AP before my L/C is approved? Hope this question is not too silly.
