If your hu*****and has one year H1b, it has not problem.
I do not think kid is a advantage. Only your kid is in America, and you could not be back to America, it may be helpful. I know some illegal immigrants cases, the America kids are helpful because they are in America, and one father or mother is America citizen, but the another one is in deportation.
