No, you can REFILE the perm with the exactly the same petition of you LC and keep the old priority date. You don't have to get two I-140 approved to keep the old priority date. Actually, I did refile a perm for my non-RIR LC last Nov and got the perm certificated with the old priority date (June 2004). Ask you lawyer about this alternative.
