Thank you for your answer. My 140 was approved and 485 is still pending, if I file 1040, may I claim the treaty? I think I should file 1040 resident for tax purpose only, because I met the substantial test, rather than I am a resident. I am worrying about if my 140 approval and GC application will affect my claiming the treaty article 19?
