You may have not choice if he was out of status in America for over 180 days or more.
I know some one is out of status with H1b, and he was refused to issue H1 visa although he has family in America.
However, if he 130 or others, you can wavier and it will short the time for waiting back to US. But I do not know what is the notice you get. So, it is better to look for an local attorney to help you.
