国内化学博士, 来美做POSTDOCT 5年, 现在一大学(TOP 60)做ASSISTANT PROF. 30 PUBLICATIONS (HALF PUBLISHED IN TOP INTERNATIONAL JOURNALS), 3 USA PATENTS + 4 CHINESE PATENTS, CITATIONS OVER 50, GOLD METALS OF A PROVENCE LEVEL,SEVERAL AS REVIEWERS FOR SEVERAL INTERNATIONAL JOURALS. 这是基本情况.

申请的NIW (TED 7 LETTERS, 其中一封来之USA院士)
RD：9/18/2005 VSC
transfer to NSC 5/10/2006
ask for RFE: 9/20/2006 AFTER I CALLED USCIS
REF list 1 项: LET ME SHOW RESEARCH INFLUENCE GREATER THAN AVERAGE
11/21/06, 寄出了REF with SOME NEW PUBLICATIONS, CITATIONS AND 5 MORE LETTERS

1月底 CALL USCIS INQUIRE STATUS. 3 天后收到DIRECT 锯信
“首脑”说的理由是: 我的CASE 没有超过EXCEPTIONAL LEVEL.

请求小白兔等好心人能给一些意见, 如何处理? APPEAL是否可行? 是否同时在申请I140? 如果这样, EB1 和NIW 同时递交, 还是只申请一种? 这几天不能入睡, 但没有好的办法出来. 恳请帮忙.
